DACA provides few significant advantages to recipients. They can live and work in the U.S., obtain social security numbers, and get driver’s licenses. However, it is important to know that it is not a pathway to a green card and citizenship. DACA status only triggers a “deferred action.” This means the recipients are protected from removal efforts as long as their program status is active and they do not have any disqualifying criminal record.
DACA relief is issued in two year increments, so it is important for the recipients to renew. There has been situation where renewals have been temporarily halted in the past, so it is important to consult an experienced immigration attorney for advice.
For those who entered the U.S. before the age of 16 years old, can qualify to receive permission to remain in the U.S. and work lawfully in the U.S. if they meet the following criteria.
- You are under the age of 31, as of June 15, 2012;
- You arrived in the U.S. prior to turning 16 years old;
- You have continuously resided in the U.S. since June 15, 2007;
- You were physically present in the U.S. on June 15, 2012;
- You entered the U.S. without inspection prior to June 15, 2012, or your immigration status expired prior to June 15, 2012;
- You are currently in high school, have graduated high school, or are working towards your GED; and
- Have not been convicted of a felony, significant misdemeanor, three or more misdemeanors, and do not otherwise pose a threat to public safety or national security.
