Q. What is a special needs trust?

A. A special needs trust (SNT), also called a supplemental needs trust, is a trust created for an individual who has special physical, cognitive, or emotional needs. Some of these individuals may also be eligible for government benefits that are only available to people with limited income. The SNT assets are available to the beneficiary to supplement, but not replace, the government benefits. The trustee has complete discretion to determine when or if any distributions will be made. Assets in the SNT also cannot be used for basic support needs of the beneficiary, or the individual risks losing the government benefits. SNTs can also protect the individual’s assets from creditors and financial predators.
