Q. Should I apply for a fiancé visa or a spousal visa?

A. If you are not married, then you should apply for a fiancé visa. If you are already married, you can apply for either a K-3 visa or an immigration visa. Which option you choose will depend on various factors, such as the time, cost, and waiting period. Fiancé and K-3 visas will usually get you into the United States quicker, but you would be entering as a non-immigrant. Once you enter the United States, you will have to wait another six to nine months to receive your green card. If you go the route of an immigrant visa, it will take longer to arrive in the United States, but you will be entering as a lawful immigrant. The overall cost for going initially with the immigrant visa will be less because you would be skipping the K-3 visa step.
